Introduction
Love by Name is a dating service matching Members based on their full name, gender requirement (ie man seeking a woman), and age requirement. Due to our matching system members are unable to randomly search profiles on the Site. There is no joining fee or monthly subscription, instead, members purchase credits through PayPal. It's free to view selected matches profiles and members are required to purchase 'Credits' to connect with those Members.

The Terms and Conditions of the Love by Name website will apply in its entirety when you become a Member of the Site. This is a legally binding contract between you, the ‘Member’ and Love by Name Limited, the ‘Site’. By becoming a member of the Love by Name website you are agreeing to, and accepting the terms and conditions as laid out in this document.
Love by Name is an internet dating service matching members based on their full name and personal preferences (i.e Gender, man looking for a woman) and age requirements.
Love by Name Limited is a private limited company incorporated in England and Wales with registered company number 8512529 whose postal and registered office is 14 Sallow Close, Bicester, Oxfordshire, OX26 3YP, United Kingdom.
This Agreement is subject to change by the Site at any time, with or without notice. Your continued use of this Site or the Services after the posting of revisions to this Agreement will constitute your acceptance of such revisions.

"Agreement", “Document” means the terms which govern these Terms and Conditions;
“Matching system” means the compatibility matching algorithm based on personality types from Members' full names.
The document titled "What is meant by your full name?" describes the information we require to match you with compatible members.
"Credits", members need to purchase credits through PayPal in order to connect to other members.
"Account", refers to the person interface which is accessible to members and identifies them on the website, this permits them to modify their profile and pay for credits enabling them to connect to other members selected by the matching system.
"Profile", refers to members' information including his/her characteristics, photos, hobbies, interests, and self-description.
"Event", allowing members to participate in free or paid for events to meet in person.
"Member", refers to a person who has joined the Site and completed a profile, and is added to the database.
"The Love Calculator" refers to the free compatibility matching tool located on the Home Page of the website.
“Connection” means matching or connecting one member to another member selected by the Site using a compatibility matching system.
"Pay-Per-Connection” means paying one credit for each connection made. Compatible members are selected by our matching system. There is no joining fee or monthly fee, members who want to connect to other members (selected by the matching system) will need to purchase credits, in advance, via PayPal. The cost is listed on the website footer and may be subject to change.
"Member Profile", refers to the personal information created by the member.
3. Registration to the Site
3.1 To become a member of the site you must be at least 18 years old and reside in one of the London Boroughs. By registering to use the site and services you are agreeing that you are single and not married or in a Civil Partnership or cohabiting with another person in a relationship. You are only permitted to create one profile or account. You are prohibited from opening an account for another person. By registering with us you are confirming that (i) you are over 18 years old; (ii) you have not previously been banned (Blacklisted) from the Site; (iii) you do not already have an account or profile registered with us. You agree that all information you provide in your profile/account will be truthful and accurate and you will maintain the accuracy of this information. You are prohibited from divulging your personal contact details ie your email address, postal address, telephone number on your profile/account. You must complete all mandatory fields highlighted by an asterisk* on the registration form and ensure that you have read the document or any other information relating to "What is meant by your full name?" This information is crucial to the system working for you. There are mandatory questions and when completed, will not be disclosed to other members on the Site; your full name, email address, your Date of Birth.
3.2 There is no joining fee, membership fee, or monthly subscription. You pay only when two members (You and another member) agree to 'connect’. The Site makes no guarantee that compatible matches will be found and it is unable to guarantee the number or frequency of the matches through the site.
3.3 The Site will not be liable for the accuracy or inaccuracy of information and content provided by members. Members will indemnify Love by Name for any claim arising in connection with any fraudulent claim made by members.
3.4 Members are unable to randomly search profiles on the Site, this is due to the nature of our matching system.
3.5 The Site is unable to carry out any form of criminal history, this includes a Disclosure and Barring Service (DBS) or credit checks on any of its members. Members are solely responsible for taking appropriate safety precautions in connection with the use of the Site.
3.6 You are advised to exercise caution when divulging personal information to another member. You should exercise the same caution you would normally exercise when you meet new people. We cannot be liable for false or misleading statements made by members.
4. Payment Terms
4.1 Lovebyname.com is a pay-per-connection internet dating site. Members will need to purchase ‘credits’, this means that if compatible matches are found he/she will need to pay one credit per connection request. If the other member does not wish to connect, one credit will be returned.

5. Your right to cancel
5.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the member has fourteen days from the purchase of Credits to exercise your rights to cancel. Any used paid-for-Credits will not be refunded but any remaining paid-for-Credits will be refunded to you. The reimbursement will be made within 14 days from the date Love by Name was informed of the Member's decision to cancel, by the same means of payment that was used by the Member. 6. Use of the Website
6.1 The Love Calculator is a free compatibility tool located on the Home Page of the website. The free tool is for visitors to the Site and no personal information is collected or stored. The purpose of the Love Calculator is to demonstrate the matching system and does not imply that names entered are current members or past members of the Site. You should bear in mind that the Love Calculator will give a more accurate score if a full name is used rather than nicknames or shortened versions of names.
6.2 Your membership and personal profile are password-protected and are strictly private and confidential and must not be passed on or shared with any third parties. When you register with us you will receive a welcome email giving you a temporary password. You are encouraged to change your password as soon as practical. For security reasons, changed passwords are not stored on our system.
63 Members must ensure that all information contained in their personal profile (including a photograph) is accurate, true, and not misleading. The site administrators will manually check that members' photos are compliant insofar as they do not breach indecent or lewd photography. This will not delay members' profiles from being uploaded to the database.
6.4 Members are solely responsible for the personal information they provide including their full name and personal preferences. The Site, therefore, cannot be held liable for members who provide incorrect information. You are advised to read the information contained in the document ‘What is a full name?'
6.5 Lovebyname.com is a pay-per-connection internet dating site with no joining fee or monthly membership fee. The Site is different from other dating sites insofar as members are unable to search profiles on an ad-hoc basis. Our matching system is very specific and is based on personality types through members' full names.
6.6 Once compatible matches have been selected Members will receive notification by email, usually on a daily basis. You will be required to login to your account to view the matches. You have the option to connect or decline the other member(s). You will have a period of up to 72 hours to decide whether you want to make a connection or not; should you decide to connect with one or more members (this is providing one or more compatible members have been selected for you) one credit will be deducted from your account for each connection you make.
6.7 If the other member does not want to accept your request to connect with them within 72 hours your account will be refunded; a refund will also be credited to your account if the other member has not taken action within 72 hours. If both members agree to connect (accepted connections) you can start to message each other through the Site. We do not recommend that you communicate with members outside the Site (through your personal email account or mobile phone) until you feel comfortable doing so.
6.8 Lovebyname.com is a pay-per-connection Site that connects one member to another member. The Site cannot be held liable or financially responsible for any arrangements that members make.
6.9. The Site cannot be held liable or responsible for members who fail to communicate and/ or fail to show for a prearranged meeting.

6.10. Pause Account - Members have a facility to pause their account at any time and for as long as you need. When your account is paused you will no longer appear as a match for other members. You can reactivate your account at any time. Unused credits will be banked and can be used in the future.
7. Your Safety and Security
7.1 It is important that you understand that the Site enables you to find compatible matches based on a members' full name. We are unable to guarantee any information provided from other members and the responsibility rests with each member to decide whether another member is the right person for them.
7.2 As a member you remain solely responsible (and liable) for the use of your identification information by third parties or for the actions or statements made through your member's account, whether these be fraudulent or not.
7.3 When arranging to meet another person through the use of the Site, you must take appropriate precautions and follow the safety guidelines in our dating safety advice section. Any such meetings are at your own risk and are not our responsibility.
7.4 You are responsible for the acts or omissions of any third parties who use your identification information or account, whether fraudulent or not. You agree to indemnify us against any claims of this kind. For the avoidance of all doubt; we shall not be liable if your identity is used by someone else.
7.5 If you feel or suspect that there has been a breach (of any kind) of your account and or the information displayed on your profile then you must immediately notify us. Furthermore; you should also change your password.
8. Member Obligation – Acceptable Use
8.1 As a Member you may use the Site only for lawful purposes. You may not use the Site: for professional, commercial, profit (Advertising, soliciting clients) or generally for non-personal purposes. You may not use the Site for solicitation or prostitution. Members are not to harass other Members. In connection with the Site breach of any applicable law, regulation, or code of conduct; make comments, broadcast, or publish in any form whatsoever Member content or any other content that infringes the rights of others or that is defamatory, injurious, obscene, offensive, violent or can/does incite in general; not to make any comment (whether in writing or verbally) that is contrary to the purpose of our Site's current rules and laws in force or acceptable norms and standards; upload photographs and any other information in terms of data or files supplied by a member that is indecent or contains minors. Photographs and other information in terms of data or files supplied must refer exclusively to the member; knowingly transmit any data, send or upload any material that contains viruses, Trojan Horses, worms, time-bombs, logic bombs spyware, or any other harmful programs designed to adversely affect the operation of any computer software or hardware.
8.2 You agree not to use the Services for junk mail, spam, and pyramid, or similar or fraudulent schemes.
9. Member Content
9.1 Members are responsible for all information provided. Lovebyname.com cannot be held liable for any misuse thereof by any other user or third party.
9.2 The information supplied by a member must be accurate and true to form. The consequences of disclosing information on the life of the member or of other members are the sole responsibility of the member concerned.
9.3 Consequently, he/she waives all recourse against lovebyname.com, notably on the basis of any possible damage to the member's right to his/her image, the member's honour and reputation, or the member's privacy, resulting from the dissemination or revelation of information concerning the member under the conditions foreseen by this agreement since the member has given his/her prior, free and express consent to such revelation through his/her registering with the Service and in the application of this Agreement.
9.1 Members are responsible for all information provided. Lovebyname.com cannot be held liable for any misuse thereof by any other user or third party.

9.4 We reserve the right not to accept or to suspend or remove from our Services all or part of any profile, personal ad, or any other Member Content for any reason we deem fit.
9.5 We are not liable for member content or other activities of Members which may breach the rights of other Users or third parties.
9.6 Members are urged to notify us of inappropriate member content. You acknowledge that such notification may take place and that we may take steps outlined in this Agreement in respect of such information which comes to our attention.
9.7 Report Abuse. The Site takes abuse by other members very seriously. We have a facility to report abuse "Report this member", which is a facility that members who have "accepted connections" and have started to message members through the Site. All instances of abuse reported to us will be investigated. This may result in the reported abuser's membership being permanently removed from the Site and any credits that remain on the Members 'Credits Statement account will not be refunded. Members will be informed by email about the closure of his/her account.
9.8 Blacklisted Members. The Site reserves the right to blacklist members if he/she conducts themselves in any improper or unlawful manner or in breach of any part of the terms and conditions. This list is not exhaustive:
a. Harass other members or disclose personal information about others that could amount to harassment.
b. Publish, post, upload, store or disseminate any unlawful or defamatory, infringing, obscene, sexually explicit, harmful, confidential, libellous, hateful, threatening, or otherwise illegal material or information, or anything which might constitute a criminal or civil offense.
c. Upload files that contain viruses, corrupted files, or any other software or programs that may interfere with or damage the operation of the Site.
d. Use software or any other means to harvest information from the Site.
e. Send chain letters, junk mail, spam material, or any other bulk communication.
Blacklisted members will be permanently removed from the Site and any credits that remain on the Members 'Credits Statement account will not be refunded. Members will be informed by email about the closure of his/her account.
10. Events
10.1 Members who have requested to attend in person, free, or paid for events will be notified by email of the details of the organised event. If applicable, and subject to notifying us in advance, they may invite guests. Our matching system is very specific and because of this, we have to ensure that there is interest from other compatible members.
11. Access to the Website
11.1 To use the website and services Members must have the necessary hardware equipment and software and the necessary parameters required to properly use the website i.e, access to the Internet. Members are also required to have the latest version of the Internet browser, activated JavaScript functions, permitted session cookies. Love by Name has security measures in place in connection with the use of the website however, Members acknowledge that due to the nature and limitations of the Internet, Love by Name is unable to warrant that any connection to the Internet or mobile application will be completely secure.
11.2 Logging into the Website requires the placement of essential cookies on your device to recognise that you can move from page to page under the same login.
11.3 The relevant hardware will need an internet/broadband connection, computer, laptop, tablet, and/or smart mobile phone (web-enabled devices). It will be your responsibility to familiarise yourself with the devices and continue to subscribe to your preferred internet/broadband supplier at your own expense. It will be at your discretion and financial responsibility if you deem it necessary to upgrade the web-enabled devices at any time.
11.4 The operation of the Services may be temporarily interrupted due to maintenance or updates to the contents.

Love by Name is only liable for the hyperlinks it creates in the Website and does not exercise any control over the Third Party Websites and external resources (third-party websites or mobile applications, social networks, etc). to which the hyperlinks accessible on the Website and Services redirect. Love by Name cannot be held liable for the provisions of links directing to Third Party Websites and cannot be held liable for their content, advertisements, products, features, services, or any other elements available on or based on the use of Third-Party Websites. It is reminded that the consultation and the use of Third Party Websites are governed by their condition of use and that such consultation and the use will be made under the Member's or Subscriber's full liability.
12. Ownership of Intellectual Property
12.1 You hereby acknowledge and agree that lovebyname.com is the owner of highly valuable proprietary information, including the trademarks, logos, and texts featured on our website without limitation, the bespoke matching algorithm system and the Love Calculator, using members’ full name and owns and hereby retains all proprietary rights in the Services and the Site, including but not limited to, all Confidential Information.
12.2 Members are prohibited from modifying, copying, reproducing, disseminating, transmitting, exploiting for commercial gain, and/or distributing in any form whatsoever the Services, from all of our website pages or software codes for elements comprising any element of Services and website.

13. Applicable Law - Disputes
13.1 These terms of use are governed and applied in accordance with the laws of England and Wales.
